InsightAccess HRIS Employee Portal: User Agreement

Welcome to the InsightAccess HRIS Portal (the “Portal”). This Portal is provided by
CXS Analytics Sdn Bhd (“InsightAccess,” “we,” “us”) on behalf of your employer,
John Clements Consultants, Inc..
Your use of this Portal is a condition of your employment and is governed by the following terms and
conditions (the “Agreement”). Please read this Agreement carefully. By logging in to and using this Portal,
you signify that you have read, understood, and agree to be bound by these terms.
1. Acceptance and Use of the Portal
You agree to use this Portal solely for legitimate, employment-related purposes as an employee of
John Clements Consultants, Inc.. Your access to this Portal is a privilege tied to your employment and will be
terminated upon the end of your employment.
2. Your Account Security
- Confidentiality: You must maintain the confidentiality of your username and password.
- No Sharing: You agree not to share your login credentials with anyone else for any reason.
- Immediate Notification: You must immediately notify your HR Department if you know or suspect any unauthorized use of your account or any other breach of security.
3. Acceptable Use Policy
You agree NOT to use the Portal to:
- Upload, post, or transmit any data that is unlawful, fraudulent, malicious, defamatory, obscene, or otherwise objectionable.
- Attempt to gain unauthorized access to any part of the Portal, other employee accounts, or any computer systems or networks connected to the Portal.
- Introduce any viruses, Trojans, worms, or other material that is malicious or technologically harmful.
- Use the Portal in any way that could damage, disable, overburden, or impair the service or interfere with any other party's use of the Portal.
4. Data Privacy and Your Information
We take your privacy seriously. Your personal and sensitive personal information is protected by Republic Act
No. 10173, the Data Privacy Act of 2012 (DPA). By using this Portal, you acknowledge and understand the following:
- Who Controls Your Data? Your employer, John Clements Consultants, Inc., is the Personal Information Controller (PIC). They determine the purposes for which your personal data is collected and processed.
- What is Our Role? InsightAccess acts as a Personal Information Processor (PIP), processing your data securely on behalf of and upon the strict instructions of your employer.
- Purpose of Processing: Your information is collected and processed through this Portal for legitimate employment purposes, including but not limited to:
- Payroll administration and timekeeping
- Leave and benefits management
- Performance management
- Compliance with government reporting (e.g., SSS, PhilHealth, Pag-IBIG, BIR)
- Accuracy of Information: You are responsible for ensuring that the personal information you provide and maintain in the Portal (such as your home address, contact number, and dependents) is accurate, complete, and up-to-date.
- Your Rights as a Data Subject: Under the DPA, you have the right to be informed, to access, to object, to erasure or blocking, to rectify, to data portability, and to file a complaint with the National Privacy Commission. To exercise any of these rights or if you have questions about how your data is handled, please contact the John Clements Consultants, Inc. HR Department or your designated Data Protection Officer (DPO).
5. General Terms and Conditions
- Intellectual Property: The InsightAccess name, logo, and all content and software within this Portal are the property of CXS Analytics Sdn Bhd and are protected by copyright and trademark laws. You are granted a limited license to use the Portal for its intended employment-related purposes only.
- System Security and Integrity: To protect your account, your data, and the integrity of our system, we may employ security measures that monitor user interactions. This may include the analysis of technical data (such as clicks and mouse movements) to detect and prevent fraudulent, automated (bot), or unauthorized activity. This information is used solely for security and operational purposes.
- Disclaimer of Warranties: This Portal is provided on an "as is" and "as available" basis. While we strive for accuracy and reliability, InsightAccess is not liable for any inaccuracies resulting from incorrect data entry by you or other authorized users from your company.
- Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the Republic of the Philippines.
- Changes to Terms: We reserve the right to modify these terms from time to time. If we make changes, we will notify you, and your continued use of the Portal after such changes will constitute your acceptance of the new terms.
